It's automatic. He hurt a biker. If he had just been caught DUI, it would simply be a felony. But he hit someone.Misdemeanor DUI's can be punished by up to a year's jail time. Felony DUI means a longer term. 2 out of 2 found this valuable. Do you? |

I have been going through this with my wife who was hit head-on by a drunk driver back in April 2008. He was charged with felony DUI, but pleaded guilty to a lessor charge. He blew .18 on scene and .19 after lab test were done by the state police. Even so, this was his punishment: 1. 90 days in jail (no early release) 2. $6,000 fine 3. Court costs ($2,500) 4. His car was booted for 1 year. 5. Placed on probation for 3 years. 6. Must attend AA meetings. 7. 1,000 hours of community service 8. License suspended for 1 year. Oh yeah, and this was his first offense. As for my wife: 1. Broken left leg. 2. Broken ribs 3. Torn ACL and MCL (left leg) 4. Sprained ankles 5. Torn MCL and ligaments (right leg) 6. Severely bruised chest (impact of air bag) 7. Three surgeries to repair Tibia, ACL, knee cap 3 out of 3 found this valuable. Do you? |

"Terminator Kid viciously mauls bicyclist half to death" would garner more attention than "Terminator Kid injures bicyclist." Do you find this valuable? |
