I don't drink at all any more, but when I did drink I would NEVER get into a car and try to drive it if I had consumed ANY alcohol. Anyone who drinks and drives (whether they cause an incident or not) should have their licence revoked for a minimum of 2 years, and then have to have intensive training before they can apply for a new licence. This should be a no tolerance policy. There is absolutely NO excuse. /end rant. . 2 out of 2 found this valuable. Do you? |

Ok, I have to play devil's advocate here, because at this point, he has only been charged, and the whole thing is under investigation. There are many things that could have happened that we just don't know about. I saw this and it made me really wonder about this biker: "TMZ has obtained the police report from Thomas Dekker's DUI bust in North Hollywood late last night -- which states the actor hit a 17-year-old kid who was trying to ride his bike past a freeway on-ramp. According to the report, CHP officers who arrived to the scene claim they observed "a collision involving a silver Toyota Matrix and a bicycle blocking the #2 lane on the on-ramp." With that being said, the way that I am reading this is that the person on the bike was trying to cross a ramp on a freeway, what the heck would you be riding a bike there for?! And, if it was at night, who knows if he could even have been seen by Dekker? If the cops saw it right after it happened and he was freaking out, maybe they took that as being intoxicated. The point is, who knows? At this point, it's all conjecture and the media loves to blow this stuff way out of proportion. I'll hold off on forming a full opinion until I know more. LM, I am really sorry about your wife and I really hope that she continues to improve. That's very scary and having lost family members and good friends to DD, I can sympathize. Heres a stat, that I know you will be amazed at, and wonder if its really true. I just heard this myself a couple years ago.From my experience with people, life , sadly its probably . Research has shown that first-time DUI offenders have driven drunk an average of 87 times before they’re finally arrested. @KyrieIt doesn't matter if the kid was at fault. He'll still probably be charged with DUI if he failed the test. He was not suppose to be in the car drunk and on the road. So, either way he will probably be considered at fault. Do you find this valuable? |

"@KyrieThen the blame is to be split 50/50. Dekker should not have been behind the wheel whilst intoxicated. The cyclist should not have been on a freeway on-ramp at night. It's one of those things where, had this not happened, Dekker would've just driven home and slept it off (he may not have felt drunk at all). But by Sod's Law, some idiot just happened to be pulling a stunt in Dekker's path that night. Do you find this valuable? |

They're going to charge you regardless of anything else. Now, maybe his status will help him some. Probably not, but who knows. Do you find this valuable? |
